3.0 Product safety # Issue
In the meat industry, the product safety is very important and the
company must pay a lot of attention on it. As for IBL Sdn. Bhd., its main
responsibility is to control the product quality, hygiene and safety is needed.
In order to avoid legal risk, understand and follow the rules of the import
country is very important.
3.1 Meat quality and its ingredients
While exporting meat to China, there are a few regulations regarding to
product safety is shown in the Law of China (1983). In the Law, it stated that
the food (include meat) must be not toxic and harmless. The product should also
conform to proper nutritive requirements and should have appropriate sensory
properties such as fragrance, colour and taste. Any poneultry, livestock that
have died due to diseases, toxic or some unknown reason
are also not allowed for the use of marketing. These two points mean that IBL
Sdn. Bhd. should be careful when buying raw meat and must confirm that the meat
is healthy. Next, in the aspect of the food additives, which means the
flavouring, colouring and the preservatives are also being mentioned in the Law.
The law states that the food additives must meet the quality standard and be
produced by factories who have the authorities to do so. The use of the food
additives must also meet the hygiene standard which is shown in the hygiene
management regulations. The use of substandard or lower quality food additives
are not allowed.
3.2 Product Hygiene
In order to keep quality assurance of the meat, several external factors
or environment should also be taken care of such as the container that used for
transportation and its package. Under the law, it said that containers and
equipment that are used for the purpose of transportation, loading and
unloading of meat must meet the hygiene requirements and standards in order to
prevent food hygiene and quality problems. Besides, packaging of the meat that the
material are made by paper, plastic, rubber or other material as well as paints
and coatings must be manufactured by authorized factories. This is because the
package has a direct contact with the meat itself. Unclean or toxic package may
affect the quality and hygiene issues to the meat and the company’s products.
If the IBL Sdn. Bhd. did not achieve and do as the rules and regulations
states, it will face legal responsibility such as penalties by fine with not
less than 20 yuan and not more than 30,000 yuan or even the revocation of the company’s

There are several measures that are able to help provide assurance and
legal protection to IBL Sdn. Bhd. regarding to the product safety issue. First,
IBL Sdn. Bhd. should assign their production department to double check in
order to make sure that the amount of additives within the meat is still with
the standard. Next, purchase department should send a team to pay the supplier
a visit and also do some checking with the livestock. This is to make sure that
the supply of the raw meat is in quality assurance. IBL Sdn. Bhd. should also
make sure the container and the ship to be used for export is being cleaned
every day and good in hygiene. Lastly, supplier of the packaging material
should show us the document which proves that the material of the package is
nontoxic and unharmed to the consumers.
4.0 Package labeling # Issue
Package labelling is a very important and IBL Sdn. Bhd. should also
always put a lot of attention in this issue. Package labelling enables the IBL
Sdn. Bhd. to share and provide necessary information to the consumers.
Providing information to the consumer is a mean of respect to the human rights
and keep the consumer safe while using the product. In the package of meat, it
could be plastic package or can.
USDA (2017), it has stated that in order to export meat to China, the exterior
label should include Chinese and English. Within the exterior label, it is
stated that several elements must be included, which are Product name, Country
of origin, Establishment number, Production date, Expiration date, storage
period or shelf life, Storage temperature, Country of destination, Net weight
(English), Inspection legend (English), Name and address of Company (English),
Production Lot number (as defined by the exporter), Specification (refers to

requirements has no restrictions on the label size, colour, size of the wording
as long as it is legible and easy to read (USDA 2017).
This is a very
important information for meat exporters who want to export to China. The
reason is because they may prohibit the entrance of the product due to not
following the labelling requirement of China and cause the issue of unclear

In order to
avoid or prevent this to happen, some general measures could be taken in order
to lessen or eliminate this legal risk. Before loading the cargo (meat)
onboard, IBL Sdn. Bhd. should assign a team of workers to do the final checking
of the product and determine whether the product labels in as follow to the
requirement of China. The team needs to put more attention on checking the
production lot number, expiry date, production date, and the specifications.
Making a final checking can lessen the chances that IBL Sdn. Bhd. in facing
this kind of legal risk, and this would help IBL Sdn. Bhd. to avoid paying
extra cost or face loss.
